USER CONTRACT
Welcome to CanvasPress.com. Canvas Press is owned and operated by Still Lens LLP. Please review the following basic rules that govern your use of the CanvasPress.com site. Please note that your use of the CanvasPress.com site (the "Site") constitutes your unconditional agreement to follow and be bound by these Terms and Conditions. Although you may "bookmark" a particular portion of this Site, bypassing this Agreement, your use of this Site still binds you to these Terms and Conditions. CanvasPress.com reserves the right to update or modify these Terms and Conditions at any time without prior notice to you. Your use of the Site following any such change constitutes your unconditional agreement to follow and be bound by these Terms and Conditions as changed. For this reason, we encourage you to review these Terms and Conditions whenever you use this Site.
Payment
All prices and amounts shown on this Site are in U.S. Dollars (USD), unless otherwise noted. If a User submits a request on the Site to purchase printing products, design services or other services, the User agrees that all charges, taxes and shipping/handling fees will automatically be charged to the credit card or paid by User with an approved payment method. We require each order to be fully paid, including shipping and handling fees, if applicable, before we complete an order. We will not start working on a print job until we receive the full payment.
Once a print job has been finalized and "sent to press" on the Site, no changes are allowed to the artwork files, job characteristics, or printing turnaround time. After a print job has been sent to CanvasPress.com’s production department, the customer is responsible for paying the entire amount of that print job along with applicable taxes and shipping/handling fees, unless otherwise noted.
Refund/ Return Policy
All sales are final since we customize each order according to your exact specifications. No refunds are given once CanvasPress.com begins working on your order, which means CanvasPress.com has received your necessary materials (i.e., digital files and payment) and started work on your job (i.e., your job is in production), however, if we verify that we made an error, we will re-run your order. You must notify us immediately upon delivery about any defects. In order to receive the replacement, you must return a swatch from the defective order postmarked within 30 days of delivery. Please contact us before sending in your return to verify your order qualifies for a return. CanvasPress.com does not accept responsibility for canvases where you have cut out a swatch of an unqualified return.
In some cases, a partial or full refund may be extended to the customer if no work has been completed by CanvasPress.com for a specific order. Please note that such refund would be adjusted to cover any fees charged for any additional services associated with that order. Shipping fees and image enhancement charges are non-refundable after the order has been completed.
Each order made from CanvasPress.com is a contract between you, as the customer making the order, and CanvasPress.com. The fact that you have made an order on behalf of a third party does not absolve you of liability to CanvasPress.com. As such, any decision by the third party not to accept the particular items printed or cancels the order the third party made with you does not affect your liability to CanvasPress.com.
Our Sales Tax Policy
CanvasPress.com charges sales tax to orders received from within the state of Texas unless you are tax exempt. If you are tax exempt, you need to send or fax to us your tax exemption certificate. Our fax number is 512-828-0325 or email accounts@canvaspress.com.
Proofs
By ordering online you are viewing an accurate preview of the cropping of your file. The thumbnail of your finished canvas represents the area that will be seen on the front of the final product. Please take note that an on-line proof is by no means an accurate color reproduction of your final printed piece but is a final opportunity for you to check the layout. If there are specific requests or adjustments needed on your order a representative may send you a separate proof via email. Once you have approved that production will proceed and no changes will be accepted. You accept responsibility for verifying the accuracy of the proof. We reserve the right to cancel orders in which no response is received to our attempts to contact you regarding issues or updates to your order.
Color Accuracy
CanvasPress.com will reproduce color from submitted files as closely as possible, but cannot always exactly match color and density. Because of inherent limitations with the printing process, as well as profiling discrepancies which may occur between your equipment and ours, the accuracy of color reproduction is not guaranteed. By placing an order with CanvasPress.com you agree to this limitation. We will try our best to match the density and color of the image, but we accept no responsibility for color variations between submitted files and the final printed piece. Application of UV coating may affect or change the appearance of the printed colors. We are not liable for the final color appearance of a UV coated product.
No Liability for Errors
CanvasPress.com is not liable for errors in a final product caused by any of the following reasons if included in the original file and or requested on the order: Misspelling, grammar, retouching mistakes or oversights, dust and scratches, incorrect color selection, incorrect canvas style selection, cropping and layout errors. CanvasPress.com does not make any changes on customer files unless enhancements are specifically requested.
Artwork Files
Our prepress department checks all submitted artwork files before printing, but you are still 100% responsible for the accuracy of your submitted files, and we encourage you to review all files carefully before submitting to CanvasPress.com. CanvasPress.com is not responsible for any issues as to orientation or alignment of your submitted files. By submitting the artwork to CanvasPress.com, you certify that you have the right to use the image(s) in your artwork files. DO NOT send any "one-of-a-kind" transparencies, prints or artwork. Although we take every precaution to safeguard your materials, we are NOT responsible for loss or damage of images or artwork. CanvasPress.com does not accept responsibility for originals or finished prints lost or damaged by the shipping company but will file claims with FedEx for orders shipped out of our facility.
Under these Terms and Conditions, you agree that you will NOT upload any artwork files consisting of the following material: any material that could give rise to any civil or criminal liability under applicable law; and any material that could infringe rights of privacy, publicity, copyrights or other intellectual property rights without the permission of the owner of these rights and the persons who are shown in the material if applicable. We will refuse an order, which in our opinion may be illegal in nature or an infringement on the rights of any third party. You accept full legal liability for the content of material processed and printed on your behalf and under your instructions. We reserve the right to refuse an order without disclosing a reason. |
